In case of reorganization of the organization, re-issuance of the license is carried out in the manner established for its receipt, at the request of the organization or its successor. When re-issuing a license in connection with the reorganization of the organization in the form of a merger, accession or transformation, a document confirming that the organization has an authorized capital (authorized capital) is not presented.

Trade in alcohol or its production is a fairly profitable business. However, to start it, you will have to overcome several serious problems. The state restricts the circulation of alcohol and introduces certain requirements for businessmen involved in it. One of them is the availability of a special license.

What is an alcohol license for?

The federal law "On state regulation of the production and turnover of ethyl alcohol" was adopted back in 1995. He controls the entire alcohol market in our country. The same law requires companies that produce or sell alcohol to have a special license.

The law has several goals. The first is to introduce general rules for all market participants. The second is to exclude as much as possible the appearance of low-quality or counterfeit alcohol. The third is to limit the sale of alcohol in general, including to preserve the health of the country's inhabitants.

The law refers to alcohol any product with an ethyl alcohol content of more than 0.5% - this category includes vodka, beer, wine, cognac and other types of products. Separately allocated alcohol-containing products - food and non-food. Raw materials include the manufacture of alcohol (for example, wort). Non-food products include medicines, perfumes and technical liquids containing alcohol. For different categories of alcohol, there are separate nuances associated with licensing.

Control over alcohol markets is carried out by a state body - the Federal Service for the Regulation of the Alcohol Market. This body issues licenses to entrepreneurs for the production, transportation and sale of alcohol.

Who should have a license

All companies that are somehow related to alcohol must have a license:

  • Manufacturers and suppliers of alcoholic beverages
  • Shops and outlets that sell alcohol
  • Catering establishments - cafes, bars, restaurants
  • Hotels
  • Other

The requirements and conditions for obtaining a license depend on the type of activity.

The law makes an exception for some companies - they do not need to have a license for alcohol. This exception applies to:

  • Retail sales of non-food alcohol-containing products
  • Procurement and transportation of technical and raw alcohol-containing liquids, including raw materials for the production of alcoholic beverages (with an annual volume of less than 2,000 liters)
  • Production and sale of beer and drinks based on it

Also, some types of enterprises are not eligible for a license. These include outlets:

  • In the territory of children and educational institutions
  • On the territory of health care facilities
  • On the territory of physical education and sports
  • In the territory of cultural sites
  • In crowded places

Entrepreneur Requirements

One of the main requirements that apply to a person who wants to get a license for alcohol is a legal entity. An individual entrepreneur cannot obtain a license. The legal form of a legal entity can be any - the presence of an LLC is already enough to obtain permission.

Another requirement is the presence of a stationary trading or production area with all the necessary utilities (heating, water supply, sewage and electricity). This is especially important for retail trade - you can’t sell alcohol in tents and stalls. The total area of ​​real estate for trade is more than 50 square meters in cities and more than 25 square meters for rural areas.

The third condition is a certain amount of authorized capital. It depends on the type of activity. For retail, it is 10,000 rubles, for production and wholesale - 10,000,000 rubles, for the production of vodka - 80,000,000 rubles. Depending on the region, the size of the authorized capital may vary. For example, in Moscow it is at least 1,000,000 rubles.

An important role is played by the location of the store or establishment. It should not be closer than 100 meters to medical, sports, cultural, children's and educational institutions, crowded places and military facilities. An exception is made for cafes, restaurants and bars: they can be located near crowded places and some cultural institutions (for example, theaters and cinema) or inside them. The radius of the “sober zone” and the procedure for its determination can also vary from region to region.

Different types of activities are also subject to separate requirements. For retail, you need a cash register that meets the requirements of FZ-54. For a cafe or restaurant, a warehouse is required and compliance with sanitary standards. Similar requirements apply to alcohol producers.

Order of receipt

Before applying for a license, you must pay a state fee. You can check the details for payment in the department of Rosalkogolregulirovanie in your federal district. The size of the fee depends on the type of activity. You can pay it by payment from your current account.

Then you need to prepare a package of documents. It includes:

  • Application for a license with registration data
  • Extract from the register
  • Copies of constituent documents certified by a notary

  • Receipt of payment of state duty for obtaining a license
  • Documents on the authorized capital
  • Documents on commercial, industrial and warehouse premises, rented or owned - technical passport, floor plan, property information

Local authorities may also request additional documents and information.

After obtaining a license

First of all, you need to place information about the license in the public domain, for example, on your website. This is necessary so that they can make sure that you have the right to produce alcohol or trade in it. After that, you can freely trade in alcohol.

You also need to connect to EGAIS, if you have not done this before. This is a single database of all alcohol products that are in circulation throughout the country. In addition, you need to file alcohol returns for each quarter. Declarations are provided in several forms - you need to fill out only those that are relevant to your type of activity:
